These General Terms and Conditions of Sale (hereinafter, the "Conditions") govern the offer and sale of "Cortigiani" branded products (the "Products") on this website (the "Site") by Gefin Srl (VAT No. 02561890282), with its registered office in Fontaniva (PD), Via del Lavoro n. 6.

Every user browsing the Site (the "User") is invited to carefully read these Conditions before completing a purchase order ("Order"). The submission of an Order implies full and unconditional acceptance of these Conditions, which form an integral part of the sales contract ("Contract").

These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Art. 12 of Legislative Decree 70/2003 and Art. 51 of Legislative Decree 206/2005 (the "Consumer Code").

Any amendments to the Conditions shall be effective from the moment of their publication on the Site and shall apply exclusively to Orders placed from that date.

1. Customers

The sale of Products on the Site is reserved exclusively for natural persons of legal age acting as consumers, i.e., for purposes unrelated to any commercial, entrepreneurial, or professional activity they may carry out (the "Customers").

Gefin reserves the right not to process Orders from subjects other than the Customer or that do not comply with its commercial policy.

The Customer may be required to provide personal data such as name, surname, email address, and delivery address. The Customer undertakes to provide true, accurate, and complete information. It is forbidden to place Orders using the identity or credentials of third parties.

The purchase of Products for resale purposes is strictly prohibited.

2. Purchase Method and Contract Conclusion

The Products offered for sale are only those present on the Site at the time the Order is placed, as described in the relevant information sheets.

The images accompanying a Product's description sheet are provided for informational purposes only and may not be perfectly representative of its characteristics, showing differences, for example, in color and size, also due to the browser and monitor used.

To place an Order, the Customer must fill out the relevant electronic form and submit it to the Seller, following the instructions on the Site. Before submitting the Order, the Customer is required to verify the accuracy of the entered data and to review these Conditions.

The submission of the Order constitutes a purchase proposal. Upon receipt, the Customer will receive an email confirming receipt of the Order, containing its identification number. This communication does not constitute acceptance of the purchase proposal.

The sales Contract shall be considered concluded only when the Seller sends the Customer a separate email confirming acceptance of the Order ("Order Confirmation"). Until that moment, the Seller reserves the right not to accept an Order, for example, in the event of unavailability, even supervening, of the Products, without any liability arising towards the Customer.

In case of partial unavailability, Customer Service will contact the Customer to arrange for a partial shipment or the cancellation of the entire Order.

In case of total unavailability, the Order will be cancelled and no amount will be charged.

3. Prices and Payment Methods

All prices displayed on the Site ("Prices") are to be understood as inclusive of VAT.

Shipping costs, where applicable, will be clearly indicated in the Order summary before payment and reiterated in the Order Confirmation.

Payments can be made through major credit/debit card circuits or other methods made available on the Site ("Payment Methods"). At the time of Order submission, a pre-authorization for payment will be requested for an amount equal to the total Price. This amount will not be immediately charged but will remain reserved until the Order is accepted. The actual charge of the Price will only occur upon the Seller's acceptance of the Order.

To ensure maximum security, Gefin uses a primary payment gateway. Information related to the Payment Method is encrypted and transmitted directly to the payment processor via SSL (Secure Socket Layer) protocol.

At no stage of the payment process will Gefin be able to know the Customer's credit card information. No computer archive of Gefin will store such data and, therefore, the Seller cannot be held responsible for any fraudulent or illicit use of credit cards by third parties during payment.

4. Shipping and Delivery

Gefin undertakes to deliver the Products via express couriers, within the times indicated during the purchase process and, in any case, within 30 (thirty) days from the date of the Order Confirmation.

The indicated delivery times are to be considered purely indicative; any delay with respect to them does not entitle the Customer to refuse delivery or to request compensation or damages.

Upon shipment, Gefin will send the Customer an e-mail notification containing the tracking number to monitor the status of the shipment.For deliveries requested in countries outside the European Union, any import customs duties will be borne by the Customer. The Customer is therefore invited to contact the customs authorities of their country in advance to verify the costs and any import limits.

Upon delivery, the Customer is required to check the integrity of the packaging and the correspondence of the number of packages. Any anomalies (e.g., damaged or opened packaging) must be immediately contested by adding a specific written reservation on the courier's delivery document, and also by promptly notifying Customer Service. This procedure does not affect the Customer's rights regarding the legal guarantee.

5. Legal Guarantee for Non-Conforming Products

Gefin is liable for any lack of conformity of the Products existing at the time of delivery, pursuant to Articles 129 et seq. of the Consumer Code. The legal guarantee has a duration of 2 (two) years from the date of delivery of the Product.

To be in conformity with the sales contract, the good must correspond to the description, type, quantity, and quality as stipulated in the contract and possess the functionality, compatibility, interoperability, and other features as provided for in the sales contract.

In case of a lack of conformity, the Customer is entitled, free of charge, to have the conformity restored by repair or replacement. If such remedies are not possible or are excessively burdensome, the Customer may request an appropriate reduction of the Price or the termination of the Contract.

The Customer is required to report the lack of conformity within 2 (two) months of its discovery. The direct action to assert the defects is time-barred within 26 (twenty-six) months from the delivery of the Product.

6. Right of Withdrawal, Returns, and Replacements

The Customer has the right to withdraw from the Contract ("Withdrawal") or to request the replacement of a Product (for a change of size or color) within 14 (fourteen) days from the delivery date, without needing to provide any reason. The request for replacement for a change of size or color is subject to the availability of the requested Product at the time Gefin receives the request.

To exercise this right, the Customer must send an explicit declaration of their decision to the email address costumercare@cortigiani.it. The communication must contain the Customer's name and surname, the Order identification number, and the indication of the Products for which they intend to exercise the right of withdrawal or request a replacement.

Following the request, Gefin will send the Customer a confirmation email with the return authorization ("Authorization") and shipping instructions. The return of the Products must take place within 14 (fourteen) days of receiving the Authorization, using the courier indicated by Gefin.

The Products must be returned intact, not used, washed, or altered, complete with all tags, security seals, accessories, and in their original packaging. The Customer is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and use of the goods.

The right of withdrawal may apply to the purchased product in its entirety; it will not be possible to exercise the right of withdrawal only on part of the purchased product (e.g., complements, accessories, etc.).

If, following the verification of the return, Gefin finds a diminished value, it may deduct a corresponding amount from the refund due, without prejudice to the Customer's alternative option to have the products returned to them, at their own expense, in the state in which they were returned to Gefin.

Once the conformity of the return has been verified, Gefin will proceed, as appropriate, to ship the replacement Product or to refund the Price paid by the Customer.

The refund will be made using the same payment method used by the Customer for the initial transaction, unless otherwise agreed.

In the event of forfeiture of the right of withdrawal, or if the return is not compliant, Gefin will return the purchased Product to the sender, charging the latter for the shipping costs and, if already refunded, the price of the product.

7. Applicable Law and Dispute Resolution

These Conditions and the Contracts governed by them are regulated by Italian law.

For any dispute arising from the interpretation or execution of the Contract, the mandatory territorial jurisdiction belongs to the court of the Customer's place of residence or domicile, if located within the State territory; or, at the Customer's choice, the Court of Padua.

Any clause which, by providing for the applicability of the legislation of a non-European Union state, deprives the consumer of the protection guaranteed by the mandatory provisions of the law that would be applicable in its absence, shall be considered null and void.

The Customer is also informed that the European Commission provides a platform for alternative extra-judicial dispute resolution (ODR platform), accessible on the website http://ec.europa.eu/odr.

9. Final Provisions

The possible invalidity or ineffectiveness of a single clause of these Conditions shall not affect the validity or effectiveness of the remaining provisions.

Any failure by Gefin to exercise its rights in relation to one or more breaches of this Contract shall not be construed as a waiver of such rights, either with respect to previous breaches or in relation to subsequent breaches of any contractual provision.
